The Planning and Zoning Commission met in regular session on Monday, Feb 4th, 2013 at 7:00 p.m. at the Mayfield Village Civic Center, Main Conference Room for a meeting of the Planning and Zoning Commission. Chairman Farmer presided.

Consideration of Meeting Minutes:  Dec 3, 2012

Mr. Fikaris, seconded by Dr. McGrath made a motion to approve the minutes of Dec 3, 2012.

Typo in the P & Z ws minutes of Jan 17, 2013 pg # 17:

Vetus Syracuse states his oldest son’s name is Mateo. It was incorrectly noted in the minutes as Natale. Correction made to Mateo.

OPEN PORTION:

Chairman Farmer called the meeting to order beginning with the 2013 Organizational Meeting portion. I want to mention we have an opening on the Ordinance Review Committee because Casey Kucharson had the audacity to move out of Mayfield Village. I haven’t had anyone volunteer for that at this point so we won’t take care of that tonight, but that’s a position we’ll need to fill this year.

I asked people to let me know if somebody had a burning desire to take over one of the following positions and I didn’t get any phone calls.

ORGANIZATIONAL:

  • Election of Chairman
  • Election of Chairman Pro-Tem
  • Election of Board of Appeals Representative
  • Election of Secretary

 

ELECTIONS:

Chairman Farmer entertained a motion for Election of Chairman, Chairman Pro Tem, Board of Appeals Representative, and Secretary for the P & Z 2013 nominations.

Dr. McGrath, seconded by Mr. Syracuse made the motion to nominate Jim Farmer as Chairman, Garry Regan as Chairman Pro Tem, Paul Fikaris as Board of Appeals Representative & Deborah Garbo as Secretary.

The nominations were closed.

Chairman Farmer asked if there was any discussion. There was none.

Chairman Farmer asked for a Roll Call on the nominations, the group as a whole.

Chairman Farmer states we have two proposals to vote on tonight. We talked about these at length at our workshop.

Mr. Marrelli said I don’t have any more information since the workshop except that more work is in progress on the design side. This will be an expansion of the existing permit from 42 to 81 units. The first time around, you granted a Special Use Permit which we’re going to change to a Conditional Use Permit. We’ll issue a Conditional Use Permit for the new 81 unit entire facility if that’s doable.  

Ms. Calta said that’s doable, but I want to make sure we’re talking about the same thing. The property was rezoned by court order as part of the settlement agreement which allowed the Assisted Living, not to just commercial, to Assisted Living. At some point, I think the misnomer of Special Use was being used. The correct terminology should be Conditional Use. We want to make sure that’s consistent because this building I understand goes over the property line.

Mr. Marrelli said besides the property line part, I think the Special Use Permit language was incorrect in my opinion.

Ms. Calta said we all agree it should have been Conditional Use.

Mr. Syracuse asked if we’ll be voting on a Conditional Use for the entire consolidated property tonight.

David Hartt replied it’ll be a Conditional Use approval for up to 81 units. On the other motion, you’d be approving that with two conditions;

  1. The Village land is sold because the site plan’s been based on that.
  2. The variances are granted from the consolidated property line including the Village land. 

 

DECISION

A) Preliminary Site Plan

Mr. Fikaris, seconded by Mr. Regan made a motion to approve the Preliminary Site Plan as presented by Governor’s Village, LLC with conditions as noted:

  1. The Village land is sold because the site plan’s been based on that.
  2. The variances are granted from the consolidated property line including the Village land.

B) Conditional Use Permit

Mr. Fikaris, seconded by Mr. Regan made a motion to grant a Conditional Use Permit for up to 81 apartments for use as an Assisted Living Facility.

Conditional Use Permit

Chairman Farmer states next item on the agenda is the Conditional Use Permit for Sign-A-Rama. Ted prepared a memorandum dated January 23, 2013.

Mr. Fikaris asked John to review the approval granted by ARB for a uniform type sign plan.

Mr. Marrelli said the Architectural Board requested that the owner of the building come in with a sign program for that whole building. At the last Architectural Board meeting there was a proposal and we received several different iterations of sizes & types of signs. The applicant is going to hang a mock up banner on the building and the ARB will go look at it. This is just to confirm agreement on the height. Once that’s agreed upon, it will be approved next week and then that’ll be the sign program for that whole front building.

Ted Esborn clarified that Sign-A-Rama has received approval for his sign at the ARB meeting of Jan 24th. ARB left it as if after the exercise of the mock up sign reveals that a better height emerges, they’ll revise the height.

DECISION:

Mr. Regan, seconded by Dr. McGrath made a motion to approve the Conditional Use Permit as presented by Sign-A-Rama based on the conditions laid out in memorandum prepared by Ted Esborn and David Hartt dated January 23, 2013:

  1. The Building Commissioner has determined and reports to the Planning and Zoning Commission that without the retail component, Sign-A-Rama is a permitted use in Office-Laboratory district pursuant to 1173.
  2. The amount of space that the applicant uses for retail purposes can be no greater than 10% of the total occupied space OR four hundred (400) square feet, whichever area is less.
  3. There will be no changes to the exterior of the building, with the exception of sign that may be approved by Architectural Review Board.
  4. Applicant has submitted to the Building Commissioner a floor plan of the space depicting the layout and arrangement of uses including area for retail sales and display (this can be done after Planning and Zoning has given approval but before occupancy permit has been issued).

WORKSHOP MEETING FEBRUARY 21st

Chairman Farmer said we have a workshop meeting coming up on Feb 21st. I might have a conflict that night.

Mr. Marrelli said we’ll be discussing the renewals for our Conditional Use Permits that expired on Dec 2012. Deacon’s are polishing up their plans and will probably be presenting at the workshop as well.

Ted Esborn said I talked to Nanci from Panzica’s today who is also shooting to be on the agenda that night for a possible Conditional Use Permit for someone looking at space in their building.
